صحيفة " النيويورك تايمز" تنشر تقريرًا مطولاً عن سجن المدون "مايكل نبيل"

نشرت صحيفة " النيويورك تايمز" أمس الاثنين، تقريرًا مطولاً عن المدون المصري "مايكل نبيل" بعد أن قضت المحكمة العسكرية العليا بسجنه ثلاث سنوات.
وقال التقرير أن "نبيل" هو أول سجين رأي في مصر بعد الثورة"، ونسب التقرير تصريحًا لأحد من محاميه "عادل رمضان" في مقابلة عبر الهاتف قال: "هذا الحكم هو تحذير لجميع الصحفيين والمدونين ونشطاء حقوق الإنسان في مصر، أن العقوبة بسبب انتقاده للجيش هو الحكم في سجن عسكري."
وأشار التقرير إلى أن التهم الموجهة ضد "مايكل" هي إهانة المؤسسة العسكرية، ونشر معلومات كاذبة عن القوات المسلحة. واتهمته المحكمة بنشر معلومات سبق نشرها من قبل منظمات حقوق الإنسان، مثل منظمة العفو الدولية حول استخدام الجيش للعنف ضد المتظاهرين، وتعذيب المعتقلين داخل المتحف المصري.
وواجهت المحكمة "مايكل" بقرص مدمج CD- - يحتوى على بعض مما نشر على مدونته تحت اسم "ابن رع".
يذكر أن "مايكل" كان قد شن حملة على الإنترنت ضد التجنيد الإجباري.

أنتقدت منظمة هيومان رايتس فريست الأمريكية الحكم على المدون المصري مايكل نبيل سند بالسجن لمدة ثلاث سنوات دون وجود محاميه بعد تماثله للمحاكمة عسكرياَ , وأضافت فى بيان لها أمس أم مايكل البالغ من العمر 26 سنة وتم القبض عليه منذ بضعة اسابيع يعد أول مدون مصرى من سجناء الضمير بعد الثورة
ودعت المنظمة فى بيانها إلى الوقوف مع النشطاء المصريين و حث سامح شكري السفير المصري لدى الأمم المتحدة لمساعدة مايكل فورا ومجانا لدفع المجلس العسكري على احترام الاحتجاج السلمي.
وأضاف البيان إن ثورة مصر لم تنته بعد وعلى الشعب المصري العمل بلا كلل للضغط من أجل الإصلاحات الديمقراطية وتحقيق مطالب واضحة لوقف القمع واقامة دولة تحترم حقوق الإنسان وترتكز على سيادة القانون.ودعت هيومان رايتس فيرست إلى تشكيل مجلس رئاسي من المدنيين بمشاركة عدد من العسكريين خلال الفترة الإنتقالية
وأضاف البيان إن المنظمة إستضافت الناشطة إسراء عبد الفتاح ، في واشنطن العاصمة حيث تحدثت مباشرة مع مسؤولين أمريكيين بشأن ما يحدث في مصر عززتها عريضة و الآلاف من التوقيعات تطالب بحرية مايكل لأن حالة القمع ليست هي الطريق إلى الأمام.
وأوضح البيان إنه لسنوات عديدة رأى الشعب المصري كيف دعمت الولايات المتحدة مبارك الديكتاتور الفاسد لكنهم ينتظرون الآن ليروا كيف أن الولايات المتحدة سوف تدعم الانتقال إلى الديمقراطية ، وعما إذا كان سيضغط على القوات المسلحة المصرية لقبول مزيد من الأصوات المدنية في الحكومة قبل إجراء الانتخابات البرلمانية سبتمبر المقبل وأنتهى البيان إلى إن النشطاء لا يستطيعون الوقوف جانبا بينما النشطاء لا يزالون قيد الاحتجاز لمجرد إنهم أحتجوا , وطالبت المنظمة السفير سامح شكري بتقديم مساعدة مجانية لمايكل سند.

يعاني المدون المصري مايكل نبيل سند من تدهور صحته بسبب إضرابه عن الطعام، وفقا لأهله ولجماعات معنية بحقوق الإنسان.
وكانت محكمة عسكرية قد قضت في إبريل/نيسان الماضي بسجن المدون (26 عاما) لمدة ثلاث سنوات بتهمة "إهانة القوات المسلحة".وأجلت محكمة الاستئناف اليوم الثلاثاء النظر في قضيته أسبوعا، وبرر القاضي ذلك بعد وجود الأوراق اللازمة أمامه حسبما قال مارك شقيق مايكل.وأعلن مايكل نبيل سند إضرابه عن الطعام في 23 آب/أغسطس الماضي، وتقول أسرته إنه يتناول الماء فقط وإنها تشعر بالقلق الشديد على صحته.
وقال مارك شقيق مايكل "لن يبقى مايكل على قيد الحياة حتى جلسة الأسبوع المقبل. لن يتمكن. كل طبيب تحدثنا إليه قال إنه لا يمكن لمضرب عن الطعام أن يبقى على قيد الحياة أكثر من 43 يوما"، مضيفا أن الأسرة تريد أن تزور ابنها لتقنعه بأن يأكل.
وقالت منظمة "مراسلون بلا حدود" إن مايكل الذي وصفته بأنه "سجين ضمير" يعاني من مشاكل كبيرة في جهازه البولي ومن فقر الدم والجرب.
وأضافت المنظمة أنها كانت قد أرسلت خطابا إلى النائب العام المصري قبل 10 أيام تطلب فيه السماح لها بزيارة المدون، إلا أنها لم تتلق أي رد حتى الآن.
وأكدت قبل جلسة اليوم أن "هذا الاستئناف هو آخر فرصة أمام السلطات للتدليل على التزامها بحقوق الإنسان وبالعدل والديمقراطية. وعلى المحكمة أن تقر بأنه أدين ظلما في محكمة عسكرية بسبب آرائه والمقالات التي نشرها".
وقد اندلعت اشتباكات بين الشرطة العسكرية ومتظاهرين تجمعوا للتنديد بسجن مايكل نبيل سند واعتقل أحد المتظاهرين وفقا لشقيق مايكل.

Egypt Sentences Blogger to 3 Years

CAIRO — An Egyptian blogger was sentenced Monday to three years in prison for criticizing the military in what human rights advocates called one of the more alarming violations of freedom of expression since a popular uprising led to the ouster of President Hosni Mubarak two months ago.

The blogger, Maikel Nabil, 25, had assailed the Egyptian armed forces for what he called its continuation of the corruption and anti-democratic practices of Mr. Mubarak. Mr. Nabil often quoted from reports by established human rights groups.
“Maikel is the first prisoner of conscience in Egypt after the revolution,” Adel Ramadan, one of his lawyers, said in a telephone interview. “This ruling is a warning to all journalists, bloggers and human rights activists in Egypt that the punishment for criticizing the army is a sentence in a military prison.”
Mr. Ramadan said that a military tribunal had sentenced Mr. Nabil to serve his term at Tora Prison here. His lawyers and his family were barred from communicating with him after the sentencing.
The charges against Mr. Nabil included insulting the military establishment and spreading false information about the armed forces. The tribunal charged him with spreading information previously published by human rights organizations like Amnesty International on the army’s use of violence against protesters, the torture of those detained inside the Egyptian Museum and the use of forced pelvic exams, known as “virginity tests,” against detained female protesters.
The main evidence against Mr. Nabil, who blogged under the name “Son of Ra,” was a CD containing 73 screen shots of entries on his blog and his personal Facebook page, according to Heba Morayef, a researcher in Egypt for Human Rights Watch, which is based in New York.
Human Rights Watch had been calling for Mr. Nabil’s release for days.
“It’s pretty stunning in Egypt’s supposed new era of rights to see the military government prosecuting someone in a military court for writing about the military,” Sarah Leah Whitson, the Middle East and North Africa director at Human Rights Watch, said last week. “This trial sets a dangerous precedent at a time when Egypt is trying to transition away from the abuses of the Mubarak era.”
Mr. Nabil has the unusual political position in Egypt of being a pacifist as well as a champion of Israel, often praising its democracy, educational standards and innovations.
Mona Seif, a rights advocate, said Mr. Nabil may have been singled out as an easy target, partly because of previous run-ins with the military and partly because of his pro-Israel views. Mr. Nabil, who is Christian, refused to fulfill his obligatory military service in 2010 on pacifist grounds and has campaigned against forced conscription ever since, Ms. Seif said.
On his blog, Mr. Nabil argued that little changed when Mr. Mubarak was removed from power. “The revolution until now has succeeded in getting rid of the dictator, but the dictatorship is still there,” he wrote.
Mr. Nabil also wrote, “Even though the army pretended more than once to have sided with the revolution, the imprisonment and torture of activists continued exactly in the same way that used to happen before the revolution, as if nothing had changed.”
This was the third time a blogger has been brought before a military tribunal in Egypt, but the first since the ouster of Mr. Mubarak in February, when hopes for democracy had flourished. In the last two months, the military has brought hundreds of civilians before its tribunals, including scores of protesters for a variety of other acts.
On Saturday, the security services cleared Tahrir Square, killing two protesters and charging several dozen with violations of curfew and a ban on demonstrations.
The military has pledged to turn over the running of the country to a civilian government once elections for Parliament and the presidency are held.
Ms. Seif called Mr. Nabil’s sentence “a warning message” to the military’s critics that they “run the risk of being imprisoned like he is.”
“The things they charged him with, most of us could also be charged with,” she said. “The evidence and the testimony they used against him are things that I and a lot of human rights campaigners have been writing about too.”

أطلقت المنظمة الدولية لمقاومة الحرب نداء لكل الدول والشعوب للتضامن مع المدون المصرى الدكتور "مايكل سند" المسجون ثلاثة سنوات بتهمة اهانة المؤسسة العسكرية، غدا الجمعة 2 سبتمبر.وعبرت المنظمة عن بالغ قلقها في أعقاب تصعيد "مايكل" اضرابه عن الطعام ليشمل الاضراب عن المياة والدواء وقالت المنظمة فى بيان ، أن المدون السلمي "مايكل نبيل سند" بدأ اضرابا عن الطعام احتجاجا على استمرار سجنه ، والتأخير في التعامل مع استئنافه. ، وبعد أسبوع واحد صعد إضرابه عن الطعام ، والآن ترفض أيضا للشرب. وكتب يقول انه قرر ما يلي : " ابتداء من اليوم يجب أن يكون هناك أي رد ، وسوف يتصاعد الإضراب عن الطعام ليشمل المياه والأدوية وسوف. تستمر كذلك حتى الموت أو حتى أكون حرا ".
ودعت المنظمة مع أكثر من 80 منظمة تابعة في أكثر من 40 بلدا ، السلطات المصرية إلى الإفراج عن المسجون السلمي المدون "مايكل نبيل". بسبب محاكمته أمام محكمة عسكرية وعدم تلبية المحاكمة المعايير القانونية الدولية للمحاكمة. فى الوقت الذى تم اطلاق سراح واسقاط التهم فى حالات أخرى.بحسب بيان المنظمة.
وأضافت المنظمة الدولية "إن استمرار سجن مايكل نبيل سند يشكل انتهاكا خطيرا للمعايير الدولية لحقوق الإنسان التى وقعت مصر عليها " ، ويقول "أندرياس شبيك"، عضو المنظمة، أن السلطات المصرية لم تسمح لاحد اعضاء المنظمة الذي سافر إلى مصر في أوائل أبريل الماضي لحضور محاكمة مايكل نبيل سند ، ورفض السماح لحضوره المحاكمة"
وقال "أندرياس شبيك"، أن مايكل مارس حقه في حرية الرأي والتعبير فى كتاباته ويشمل هذا حقه في انتقاد دور المؤسسة العسكرية أثناء وبعد قيام الثورة ، وأن الحكم بالسجن لمايكل انتهاك واضح لتفسير المادة 19 من العهد الدولى.

On Tuesday, 23 August 2011, imprisoned pacifist blogger Maikel Nabil Sanad began a hunger strike in protest against his continued imprisonment, and delays in dealing with his appeal. Today, one week later, he escalated his hunger strike and now also refuses to drink. In his declaration of hunger strike from 23 August 2011, he wrote that he had decided: "to go on a hunger strike, starting from today. Should there be no response, I will escalate my hunger strike to include water and medicines. It will continue until death or until I am set free." [1]
War Resisters' International, the international pacifist network with more than 80 affiliated organisations in more than 40 countries, calls on the Egyptian authorities to release imprisoned pacifist blogger Maikel Nabil Sanad. Maikel Nabil Sanad was arrested at the end of March 2011, and sentenced to three years' imprisonment on charges of violation of article 184 of the Egyptian penal code, which criminalizes "insulting the People’s Assembly, the Shura Council or any State Authority, or the Army or the Courts", and article 102, "spreading false information". His trial in front of a military court and sentencing did not meet international legal standards [2]. The appeal against his sentence from April 2011 has still not been heard, more than four months later. At the same time, other prisoners are being released, or charges for insulting the military are dropped in other cases [3].
"The continued imprisonment of Maikel Nabil Sanad is a grave violation of international human rights standards that Egypt has signed up to", says Andreas Speck, War Resisters' International's Right to Refuse to Kill programme worker, who travelled to Egypt in early April to observe Maikel Nabil Sanad's trial, but was refused permission to attend [4].
Maikel Nabil Sanad was arrested and sentenced for his writings about the role of the military during and after the revolution, especially his blog post "The army and the people never were as one" [5] He is the first blogger sentenced for blogging since the toppling of Mubarak in February 2011.
Andreas Speck explains: "In his writings, Maikel Nabil Sanad made use of his right to freedom of opinion and expression. This includes his right to criticise the role of the military during and after the revolution. On 21 July 2011, the Human Rights Committee of the United Nations passed a new General Comment 34 on the right to freedom of opinion and expression. It writes: 'States parties should not prohibit criticism of institutions, such as the army or the administration.' [6]. The sentencing and imprisonment of Maikel Nabil Sanad is in clear violation of the interpretation of article 19 ICCPR, as shown in General Comment 34."
Following the escalation of the hunger strike to include a thirst strike, War Resisters' International is very concerned about Maikel Nabil Sanad's life.

تحويل "مايكل نبيل" لمستشفى مزرعة سجن طرة، بعد تعرضه للاعتداء البدني فى السجن و"الجنزوري" يعد بالتدخل

قال "نبيل سند"، والد المدون المصرى"مايكل" في تصريحات خاصة لــ" الأقباط متحدون" ، ان "مارك" ابنه الاصغر قادم بزيارة شقيقة امس في سجن المرج العمومي، وتم تفتيشه بطريقة مهينة، وفوجئ بتعرض مايكل للضرب من أحد الضباط برتبة نقيب مسجون بالسجن، وحالته الصحية متدهورة، وعندما طالب مايكل بتحرير محضر بواقعة الاعتداء البدني عليه، هدده ضابط آخر بتلفيق قضية ازدراء أديان له. وقام "مايكل" بكتابة بيان اعطاه لشقيقة يعلن فيه انهاء تعليق اضرابه عن الطعام الذى استمر لاكثر من 125 يوما، إلا ان المسؤولين في السجن رفضوا ومنعوا شقيقة من الخروج بالبيان. وقال "مارك" في تصريحات خاصة، أنه توجه أمس في الساعة السادسة مساءًا، بصحبة المحامي "امير سالم"، الى النائب العام لتقديم بلاغ لإثبات تعرض مايكل للضرب بالسجن، وتعرضه للهانة والتفتيش الغير قانونى وقام النائب العام بتحويل البلاغ الى نيابة بنها التابعة لسجن المرج العمومي، التي انتدبت وكيل نيابة وطبيب للتحقيق والكشف على الحالة الصحية لمايكل ، وتم اخذ اقوال "مايكل"، وعرضت اقواله اليوم على النائب العام الذى أمر بتحويل مايكل لمستشفى سجن المرج. واضاف والد مايكل، انه تلقى مكالمة هاتفية من السيد "كمال الجنزوري"، رئيس الوزراء، وعده فيها بالتدخل من أجل الافراج عن "مايكل" الا ان رئيس الوزراء استطرد قائلا ان الامر في يد المحكمة العسكرية، وكان والد "مايكل"، قد حاول اكثر من مرة مقابلة رئيس الوزراء ، وتحدث معه هاتفيا ، وقدم التماس لمدير مكتبه من اجل الافراج عن ابنه. وابدى والد مايكل، اندهاشه من قرار المشير طنطاوي، بالإفراج عن (90) سجين ليس من بينهم ولا مسيحي، على الرغم من كون بعض المفرج عنهم سجناء جنائيين محكوم عليهم بفترة عقوبة تصل الى سنتين مثل "مايكل".
